Section 5 of the Eswatini Data Protection Act, 2022, mandates the Eswatini Communications Commission (ESCCOM) as the Eswatini Data Protection Authority (EDPA) charged with the responsibility of maintaining a comprehensive Data Protection Register. This register lists all Data Controllers and Data Processors who, during their regular business activities, collect or process personal information

Registering with ESCCOM fulfills the Notification Requirement outlined in Section 46 (2) (a-f) of the Act. This ensures that organizations demonstrate their compliance with data privacy regulations. No Data Controller or Processor shall be recognized as such unless they are registered with the EDPA. Registration has been open from 1 March 2024, and over 80 organizations from various sectors have already taken the important first step towards complying with the Act. These forward-thinking organizations are already contributing towards a safer digital environment for all Emaswati.

Why Register?

The Data Protection Act of 2022 requires all organizations handling personal data to register with the EDPA. This includes both Data Controllers – those who determine the purposes and means of processing personal information – and Data Processors – those who process personal information on behalf of Data Controllers.

If an organization collects or processes personal information of more than 10 individuals or sensitive data of more than 5 individuals, registration with the EDPA is mandatory.
